Default Force open your network

I was just searching the web and I found this:

"The European Commission has informed Germany that a new law protecting Deutsche Telekom's fiber optic network is illegal. Deutsche Telekom is in the process of rolling out a new fiber network that will serve the 50 largest German cities by the end of 2007 and convinced the German parliament to pass a law that would keep the competition from being able to lease its lines. The EC says that's a no-go: 'The EC believes that the German law would make it more difficult for competitors to enter the German market. More importantly, it runs contrary to an EC-endorsed recommendation that Deutsche Telekom be forced to open up its network — including the new fiber deployment — to competitors.'"

Personally I don't know which side I would be on. On 1 hand, if you spend billions of dollar to built a network, why should you let someone else uses it? On the other hand, if that is the case, do we want everyone to build their own network? With 1000's of cables everywhere?

I don't think there would be a clear solution to this, tho I will try and may be give some:

1, As everyone know, the internet now is like something that is essential. We can't live without it. So may be it is time that our governments make it a public project. Not unlike a highway or bridges. Built it, than rent it out to let those using it to cover the building and maintenance cost. The down sides to this of course are all the paperwork.. and more paperwork.. And since it will be the cheapest bidder that wins, the quality of it is not going to be as good.

2, Let the guy that build it have a couple of years to recoup the cost, just like how patent medicine work. The guy who invented the medicine can have monopoly for a few years, after that it is open to generic ones. The duration of the network staying exclusive should be no more than the time it will take to recoup the cost. After that it must rent it out to others for a very competitive price. This will: allow competition and may be force them to upgrade and/or built new network.

It's simple. I live in America. The land where hi-speed Internet is either Tel controlled DSL or the local Cable Co. Which isn't all that local anymore.
Oh yeah we have Satellite which is owned by the 2 satellite TV providers. One of which is owned by a Tel Co. WOW.... and DIAL-UP cough...cough.
ISP's are really unregulated by competition and consumers don't care. All they want is quick easy access to their Ebay, Email, Bank, and Porn.
Oh wait there is competition. A client of mine was paying Covad $150 per month for 384 kbps DSL line and Verizon(local tel) would give him 1 mbps DSL for $35 per month. Verizon owns the lines.
We all know the Illuminati doesn't exist, right?
